Acceptance of Terms

These Terms of Service (the “Terms”) form a binding agreement between you and NestProof AI (“NestProof AI,” “we,” “us,” or “our”). By accessing nestproofai.com or using our mobile app (collectively, the “Service”), you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

Eligibility

The Service is intended for adults aged 18 or older who are responsible for child safety in a home. By using NestProof AI, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms. The Service is not directed to children under 13, and children under 13 may not create accounts or submit personal information.

Service Description

NestProof AI is an AI-powered educational tool that shares general baby-proofing information that may help parents and caregivers think through common considerations in their homes. The Service analyzes photos and answers questions to share educational information and editorial product picks.

NestProof AI is for general educational purposes only. It is not professional advice of any kind — including medical, legal, child-safety, or inspection advice — and it does not replace parental judgment, supervision, or the advice of qualified professionals. No Guarantee of Safety

NestProof AI is not designed or intended to detect every hazard in a home or to prevent injury, harm, or damage. Homes vary in layout and condition, photos may not capture every relevant detail, and conditions in a home can change over time. No home can be made entirely risk-free, and applying any of the educational information from the Service does not ensure safety.

Changing Conditions

Conditions within a home may change over time due to furniture movement, environmental factors, renovations, or other circumstances. NestProof AI does not warrant that previously reviewed areas continue to reflect any particular condition.

Photo Analysis Limits

Photo analysis is limited by image quality, lighting conditions, camera angles, and the inherent limits of AI models. Output may be incomplete or inaccurate and should be reviewed with your own judgment.

You retain ownership of photos and content you upload, and you grant NestProof AI a worldwide, non-exclusive, royalty-free license to host, store, process, and display that content solely to provide and improve the Service. You represent that you have the right to upload any content you submit.

Prohibited Uses

You agree not to: (a) use the Service for any unlawful purpose or in violation of these Terms; (b) upload content that you do not have the right to share, or that depicts a child without the consent of a parent or legal guardian; (c) attempt to access another user’s account or any non-public area of the Service; (d) reverse engineer, scrape, or interfere with the Service; (e) use the Service to harass, harm, or defraud others; or (f) use the Service to generate or distribute content that is illegal, harmful, or infringing.

Intellectual Property

The Service, including its software, design, text, graphics, and logos, is owned by NestProof AI or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or create derivative works from the Service without our prior written consent.

User Responsibility and Assumption of Risk

You are solely responsible for evaluating and applying any of the educational information provided through the Service based on your home, family, and circumstances. By using the Service, you acknowledge and accept all risks associated with home safety decisions and any actions you take based on information from the Service. Ongoing supervision of children, pets, and adults remains your responsibility.

Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation. NestProof AI does not warrant that the Service will be error-free or that any particular hazard will be detected.

Limitation of Liability

To the fullest extent permitted by law, NestProof AI, its affiliates, and contributors are not liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of the Service or reliance on any information provided through it, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to the Service will not exceed one hundred U.S. dollars ($100).

Indemnification

You agree to defend, indemnify, and hold harmless NestProof AI and its affiliates and contributors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your content, or your violation of these Terms.

Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service and delete your account at any time. Sections of these Terms that by their nature should survive termination will survive.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. You and NestProof AI agree to submit to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute arising out of or relating to these Terms or the Service that is not otherwise subject to alternative dispute resolution. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

Changes to These Terms

We may modify these Terms from time to time. When we do, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
